Power of attorney in visa cases


As a result of a ruling by the European Court of Justice the Dutch Immigration Service IND does not longer accept a power of attorney signed by anyone other than the foreigner person who had applied for a short time visit visa. The foreigner has to sign a letter the familymember, company/employer or friend might represent them in their appeal process or hire someone else to do it on their behalf. Otherwise they just throw the case out.


According to the European Court of Justice that is what are the implications of the Visacode. I think that in the Dutch cases that is wrong as that same Visacode says appeals are governed by national law and that also gives a referent the right to appeal. But best to avoid trouble and get the signature of the applicant as well.
